Addendum.
Executed by every Member before each TPS GT Cup race weekend. Adds racing-specific risk acknowledgments and FARA USA-administered scrutineering and conduct requirements above and beyond the Annual Waiver. This Addendum is in addition to, not in lieu of, the Annual Waiver and any facility waiver required at the gate.
Cup Participation Risk Acknowledgment, Waiver & Conditions
This Cup Participation Addendum (this "Addendum") is given by the undersigned Member (the "Driver") in consideration of being permitted to enter and participate in the TPS GT Cup race weekend identified below. The Driver acknowledges that this Addendum supplements, and does not replace, the Founding Member Agreement, the Annual Driving & Track-Day Waiver, the Society's Code of Conduct, and any facility waiver or sanctioning-body waiver applicable to the Cup race weekend.

2. Acknowledgment of Exhibition-Racing Risk.
The Driver acknowledges that participation in the TPS GT Cup involves sanctioned exhibition racing with multiple vehicles on a closed circuit at high speeds, and that exhibition racing — including the possibility of wheel-to-wheel contact — carries risks materially greater than the risks of recreational track-day driving. Such risks include, without limitation: contact between vehicles in passing or lapping situations; loss of control resulting from racing-line decisions; failure of safety equipment under racing-load conditions; mechanical failure resulting from competition stress on the vehicle; debris on the track surface from other competitors' incidents; full-course yellows and red-flag procedures requiring sudden changes in driver behavior; rescue and medical response operations; and the negligent, reckless, or intentional acts of other competitors. The Driver knowingly and voluntarily assumes all such risks in addition to the risks acknowledged in the Annual Waiver.

3. FARA USA Sanctioning Compliance.
The Driver agrees to comply with all applicable rules, regulations, technical requirements, scrutineering procedures, and on-track conduct standards established by FARA USA for the race weekend, including without limitation: vehicle eligibility and class assignment; safety equipment standards (cage, harness, fire-suppression, fuel-cell, window-net, helmet, suit, gloves, shoes, head-and-neck restraint device); driver-license and competition-credential standards; scrutineering compliance; pre-race driver meetings; flag and signal compliance; passing and racing-conduct rules; and post-race scrutineering and protests. The Driver acknowledges that any breach of FARA USA rules may result in disqualification, exclusion from the remainder of the weekend, suspension of Cup eligibility for future rounds, and expulsion from the Society at the Society's discretion under ยง10 of the Founding Member Agreement.
4. Driver Credentials & Health.
The Driver represents and warrants that:
(a) the Driver holds a valid competition license, race-school graduation certificate, or other credential acceptable to FARA USA and the Society for the Driver's class, and a copy has been provided to the Society at least seven (7) calendar days before the race weekend;
(b) the Driver is in good physical and mental health, has no known medical condition that would prevent the Driver from participating safely in racing competition, and has not consumed alcohol, illegal drugs, or any prescription medication that would impair the Driver's reaction time, judgment, or motor function within the eight (8) hours preceding the Driver's first on-track session of the race weekend;
(c) the Driver has personal medical/health insurance and motorsport-specific competition or track-day insurance covering the Driver and the Driver's vehicle while on circuit during the race weekend, and the Driver acknowledges that the Society's operations insurance umbrella is secondary and limited; and
(d) the Driver's vehicle has been mechanically prepared, scrutineered, and certified to meet all FARA USA, Society, and circuit safety requirements for the Driver's class.
5. Vehicle & Equipment.
The Driver's vehicle, safety equipment, and personal protective equipment must comply with the requirements applicable to the Driver's class. The Society and FARA USA reserve the right to inspect the vehicle and equipment at any time before, during, and after the race weekend, and to disqualify any non-compliant vehicle or driver at the Society's or FARA USA's sole discretion.
6. Livery & Identification.
The Driver's vehicle must carry the Cup-specified livery (school colors and business identity) for the duration of the race weekend, and must display all sanctioning-body, race-number, and sponsor-required signage as specified by the Society. The Driver grants the Society a non-exclusive, perpetual, royalty-free license to capture, use, and distribute photographs, video, and broadcast footage of the Driver and the vehicle during the race weekend for Society marketing, member communications, and Society partner purposes.
7. Release, Waiver & Indemnity (Cup-Specific).
The Driver, on behalf of the Driver and the Driver's personal representatives, heirs, assigns, family, next of kin, executors, administrators, and estate (collectively the "Driver Parties"), HEREBY RELEASES, WAIVES, DISCHARGES, AND COVENANTS NOT TO SUE the Released Parties (as defined in the Annual Waiver, with FARA USA expressly included) for any and all liability, claims, demands, actions, and causes of action whatsoever, in law or in equity, now and for all time, arising out of or related to the Driver's participation in the TPS GT Cup race weekend, whether caused by the negligence (including gross negligence) of any Released Party, the negligent or intentional acts of any other competitor or participant, mechanical failure, equipment failure, track condition, weather, or any other cause whatsoever. The Driver further indemnifies, defends, and holds harmless the Released Parties from and against any loss, liability, damage, or cost (including reasonable attorneys' fees) arising out of (i) the Driver's participation in the race weekend, (ii) damage caused by the Driver's vehicle, or (iii) the conduct of the Driver, the Driver's family members, crew, transporters, and guests at or near the race weekend.
8. Vehicle-to-Vehicle Damage.
In the event of contact between competitors during a Cup session, the Driver acknowledges that each driver is solely responsible for the repair of the driver's own vehicle, regardless of fault, except where (i) the at-fault driver elects in writing to compensate the affected driver, or (ii) FARA USA's race-stewards process produces a determination of liability that the affected drivers mutually accept. The Society does not arbitrate vehicle damage disputes and is not liable for any vehicle damage sustained during a Cup session.
9. No-Refund on Cancellation.
If the race weekend is canceled or curtailed due to weather, force majeure, sanctioning-body action, or facility unavailability, the Driver acknowledges that the Society will use commercially reasonable efforts to reschedule or substitute programming, but no refund of any Cup entry fee, scrutineering fee, or other transactional payment will be made.
10. Severability and Scope.
This Addendum is intended to be as broad and inclusive as permitted by the law of the State of Georgia. If any provision is determined to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
11. Acknowledgment.
The Driver acknowledges that the Driver has had adequate time to read this Addendum, has done so, and fully understands all of its terms, including that the Driver has given up substantial rights by signing it, gives up those rights freely and voluntarily, and intends the Driver's signature below to constitute a complete and unconditional release of all liability to the greatest extent allowable by the law of the State of Georgia.
